What are drug charges?

Below is a short introduction to drug charges and drug offences in Australia and Victoria.  If you’ve been charged with a drug offence, don’t wait. Contact PH Solicitors today to discuss your options.

Use – The use of illicit drugs is illegal and carries varying penalties for different drugs.  A Magistrates’ Court will deal with your case.  Penalties for cannabis use commonly attract fines but no prison sentence.  Other drugs can carry up to one year in prison or fines, or both.

Possession – The possession of illicit drugs, either on your person, in a vehicle or in property owned by an individual is illegal.  You may be tried before a judge and jury, unless you choose to have your case dealt with before a Magistrate or Judge. The level of penalties faced depends on the type of drug and the quantity possessed.  If you have been charged in possession of a small quantity you will need to prove that the quantity in question was not intended for trafficking or sale.

Cultivation – Cultivation (or growing) of narcotic plants (for example, cannabis, opium or the coca plant) may be tried before a judge and jury.  As the defendant, you must prove cultivation was not for trafficking purposes. You may face fines, imprisonment or both, depending on the quantity of cannabis grown, sophistication, and any evidence that the cannabis was for trafficking purposes.
