COVID-19: New obligation to report confirmed COVID-19 cases in the workplace to WorkSafe

Employers have a general duty of care in the workplace and if they negligently cause a workplace death - including by contracting coronavirus at work and later dying - they can be jailed for up to 20 years, or fined up to $16.5 million. This involves a serious breach of the duty of care owed to employees relating to health and safety under the Occupational Health and Safety Act 2004 (Vic). These new workplace manslaughter laws came into effect on 1 July 2020.
